Writing A Contract On A Loudoun County Home And Negotiating

Ready To Make An Offer?

  Remember when you were prequalifyed by your Lender, we now need to get you Preapproved for the loan amount and obtain a Letter of Guarantee from the Lender in order to have better bargining and negotiating power when we make an offer on your new Loudoun County Home.  I try to encourage my clients to not just get prequalifyed, but instead get preapproved as it skips this step and doesnt delay us presenting a contract.  In a Tight Sellers Market it is important to be preapproved and ready to present an offer as quickly as possible on a home you desire.  Whenever we are in a Buyers Market we can relax a little, however there is no guarantee that someone could potentially make an offer on a house you are interested in while you wait to see if they lower their price once again. 

Writing the Contract, Presenting The Offer, and Negotiating on Your Behalf

Writing A Contract:
  Once we have identified a home for which you wish to purchase we need to write up a contract.  I will sit down with you and expalin everything to you.  I will put in a price that has been determined by you, along with any other terms and contingencies that may come into play.  Remember I work for you and will help you in writing the best offer possible based on your terms and what we have agreed upon.

Presenting The Offer:
  With your permission I will then present the offer in a timely fashion to the Listing Agent representing the Seller and keep you abreast as to when I deliver it, as well as any feedback from the agent once I receive any. 

Negotiating On Your Behalf:
 
Once a contract has been written any deviation from that contract voids the original contract.  Therefore if a Seller does not accept your contract " as is" the contract is void.  If the seller counter offers because of the price or terms of the contract, the contract is void.  This is where I negotiate on your behalf.  If the seller makes a counter offer and you are still intrerested in the house I will explain the changes to the contract in detail to you to see if you agree to the new terms or wish to counter the counter offer.  This can go back and forth until both you and the seller agree on the terms and conditions of the contract.  Any addendums that need to be made in order for the contract will be valid and agreed upon by both parties.  Once the contract has been ratified by both parties the next step is to ensure all inspections repairs and promises made by each party are carried out prior to settlement.  I will look out for your best interests and ensure all that was promised and agreed upon was done, that all inspections and repairs have been made prior to closing on your new Loudoun County Home. 

Ratification:
Once all parties have agreed to all the terms and conditions as well as all addendums to the original offered contract, all parties involved in either the selling side or buyer side of the deal sign off on the contract and thus the contract has been ratified. 

Settlement:
Once all contigencies have been lifted and all agreed upon inspections and repairs have been completed, the appraisal has been done, the title company has cleared title and the lender has disbursed the funds we are then ready to go to settlement.  At the settlement table a third party addresses both sides of the sale and brings up any issues that need to be resolved prior to settlement.  If everything is in place the settlement can take as little as an hour or many hours depending on the parties wanting to go over each page of the contract and paperwork or not.  The Settlement Attorney will be there to explain and clear up any issues and I will be there by your side ensureing you understand everything the attorney is telling you should you have any questions.
